India's Simplifies Trademark Rules

In order to expedite and streamline the process of registering trademarks, the Department of Industrial Policy and Promotion in India replaced Trade Mark Rules 2002 by Trade Mark Rules 2017 which incorporate major changes in these regulations. The amended rules came into effect on March 6, 2017.

Key highlights of the revamped rules:

  • Reduction in  the number of forms from 75 to 8
  • A new category – small enterprise/startup/individual – introduced
  • Expedited processing of applications ensured
  • Electronic communications for services launched
  • Businesses may enlist well-known trademarks
  • Sound marks and 3-D marks may be registered
  • Video-conferences and other audio-visual devices of communication approved
  • Number of adjournments limited to two only by each party
  • Renewal or registrations can now be made a year before their expiration
  • Fees have been almost doubled but are reasonable by global standards
